1. Acceptance of Terms

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and BlindBuddy App ("BlindBuddy," "we," "us," or "our"). By using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Critical Disclaimer - Informational Purposes Only

BlindBuddy provides weather data, wind forecasts, tide predictions, migration patterns, hunting season dates, and other information intended to assist with hunting preparation and planning. HOWEVER:

• ALL INFORMATION IS FOR REFERENCE ONLY and should not be considered professional advice, expert guidance, or a substitute for your own judgment and research.
• DATA ACCURACY IS NOT GUARANTEED. Weather forecasts, tide predictions, migration patterns, and all other data provided by BlindBuddy are subject to change without notice and may contain errors, omissions, or inaccuracies.
• HUNTING CONDITIONS ARE UNPREDICTABLE. Wildlife behavior, environmental factors, weather patterns, and hunting success are inherently variable and cannot be reliably predicted by any application or service.
• YOU ARE SOLELY RESPONSIBLE for all decisions made based on information from BlindBuddy.
• BLINDBUDDY MAKES NO REPRESENTATIONS OR WARRANTIES regarding the accuracy, reliability, completeness, or timeliness of any content, data, or predictions provided through the App.

3. Hunting Safety - Your Responsibility

By using BlindBuddy, you acknowledge and agree that:

• YOU WILL ALWAYS PRACTICE SAFE FIREARM HANDLING in accordance with all applicable safety standards and regulations.
• YOU WILL WEAR APPROPRIATE SAFETY EQUIPMENT including hunter orange/blaze orange when required by law or recommended for safety.
• YOU WILL NEVER RELY SOLELY ON THIS APP for safety-critical decisions.
• YOU WILL MAINTAIN PROPER SITUATIONAL AWARENESS at all times while hunting.
• YOU ASSUME ALL RISKS associated with hunting activities.

BLINDBUDDY IS NOT LIABLE FOR ANY INJURIES, ACCIDENTS, PROPERTY DAMAGE, OR DEATH resulting from your use of the App or participation in hunting activities.

4. Legal Compliance - Verify With Authorities

BlindBuddy provides hunting season dates, bag limits, shooting hours, and regulatory information for reference purposes only. THIS INFORMATION MAY BE INCOMPLETE, OUTDATED, OR INACCURATE.

You Are Required To:

• VERIFY ALL HUNTING SEASONS, DATES, AND REGULATIONS with your state wildlife agency before every hunt.
• OBTAIN ALL REQUIRED LICENSES, PERMITS, TAGS, AND STAMPS from appropriate state and federal agencies before hunting.
• CONSULT OFFICIAL SOURCES including your state wildlife/fish and game department, U.S. Fish & Wildlife Service (USFWS), local county and municipal hunting ordinances, and property owner regulations and permissions.
• FOLLOW ALL FEDERAL, STATE, AND LOCAL LAWS governing hunting.

BlindBuddy Disclaimer:

• WE DO NOT VERIFY OR GUARANTEE the accuracy of any hunting regulations displayed in the App.
• REGULATIONS CHANGE FREQUENTLY and may be updated by wildlife agencies with little or no notice.
• YOU ARE SOLELY LIABLE for any violations of hunting laws or regulations.
• BLINDBUDDY ASSUMES NO LIABILITY for fines, penalties, or criminal charges resulting from hunting law violations.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLINDBUDDY SHALL NOT BE LIABLE FOR:

• ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES arising from your use of the App.
• PERSONAL INJURY, DEATH, PROPERTY DAMAGE, OR ANY OTHER HARM resulting from hunting activities.
• INACCURATE, INCOMPLETE, OR OUTDATED INFORMATION provided through the App.
• TECHNICAL FAILURES, SERVICE INTERRUPTIONS, OR DATA LOSS.
• VIOLATIONS OF HUNTING LAWS OR REGULATIONS.

YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE APP IS TO STOP USING IT.

6. Assumption of Risk

By using BlindBuddy, you expressly acknowledge and agree that:

• HUNTING IS INHERENTLY DANGEROUS and involves risks including but not limited to: firearm accidents, falls, drowning, hypothermia, heat exhaustion, wildlife encounters, equipment failure, and getting lost.
• YOU VOLUNTARILY ASSUME ALL RISKS associated with using the App and participating in hunting activities.
• YOU WAIVE ANY CLAIMS against BlindBuddy for injuries, damages, or losses.

7. User Responsibilities

As a user of BlindBuddy, you agree to:

• Use common sense and good judgment at all times
• Prioritize safety over hunting success
• Respect wildlife, habitat, and other hunters
• Obtain written permission before hunting on private property
• Report violations of hunting laws to authorities
• Hunt sober and maintain equipment in safe condition

8. Third-Party Data and Services

BlindBuddy integrates data from third-party sources including OpenWeatherMap, NOAA, eBird, U.S. Fish & Wildlife Service, and state wildlife agencies.

WE DO NOT CONTROL OR GUARANTEE THE ACCURACY OF THIRD-PARTY DATA.

9. Intellectual Property

All content, features, and functionality of BlindBuddy are the exclusive property of BlindBuddy and are protected by copyright, trademark, and other intellectual property laws.

10. User-Generated Content & Community Guidelines

Prohibited Content

The following content is strictly prohibited:

• Hate speech, discrimination, harassment, or bullying
• Violent, graphic, gory, or disturbing content
• Sexually explicit or inappropriate material
• Illegal activity or promotion of illegal hunting practices
• Spam, scams, or misleading content
• Content that endangers wildlife or promotes poaching
• Personal attacks or threats against other users
• Content that violates any applicable laws or regulations

Content Moderation & Enforcement

We actively monitor and moderate all user-generated content. Our enforcement actions include:

• Immediate removal of objectionable content
• Account suspension or permanent ban for violators
• Reports reviewed and actioned within 24 hours
• Cooperation with law enforcement when applicable

Reporting Objectionable Content

You can report objectionable content or abusive users using the report feature on any post (tap the menu icon and select "Report"). Reports are reviewed within 24 hours. You may also contact us directly at bobby@hillcountryventures.co.

Blocking Users

You can block abusive users from your feed. When you block a user, you will no longer see their content and they will not see yours. To block a user, tap the menu icon on their post and select "Block User".

Your Responsibilities

By posting content on BlindBuddy, you agree to:

• Take responsibility for all content you post
• Not post any prohibited content listed above
• Report any objectionable content you encounter
• Not harass, threaten, or abuse other users
• Comply with all applicable hunting laws and regulations

11. Subscription and Payments

• Payment is processed through Stripe
• Annual subscriptions automatically renew unless canceled
• No refunds for partial subscription periods
• Prices may change with 30 days notice

12. User Content and Data

By using BlindBuddy, you grant us a non-exclusive license to store and process your data, including GPS coordinates and saved blinds.

We may anonymize and aggregate your data for analytics, product improvement, and research purposes.

13. Termination

We reserve the right to suspend or terminate your access at any time for violation of these Terms or any other reason at our sole discretion.

14. Disclaimer of Warranties

BLINDBUDDY IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

15. Indemnification

You agree to indemnify and hold harmless BlindBuddy from any claims arising from your use of the App, violation of these Terms, or hunting activities.

16. Governing Law

These Terms are governed by the laws of the State of Texas. Disputes shall be resolved through binding arbitration in Travis County, Texas.

17. Changes to Terms

We reserve the right to modify these Terms at any time. Your continued use of the App constitutes acceptance of updated Terms.
